Bwin Loses In Belgian Court

Last month the Belgian Gambling Commission has issued a blacklisting order against renowned online gambling company bwin party digital entertainment. This was because bwin party refused to apply for a new Belgian license and pay taxes in the country. On May 9th all Belgian ISPs were ordered to block citizens’ access to all of the brands owned by bwin party such as Party Casino, Party Poker, bwin Poker and others. Immediately after the ban, bwin party submitted litigation against the Gambling Commission attracting the blacklisting of the company.
At that time bwin part argued that the actions of the Belgian Gambling Commission and Belgian authorities have caused “enormous financial, commercial and reputational damage”. Bwin party argued that the blacklist order was illegal and requested that it should be removed immediately. This week the case finally came before the Belgian Court of First Instance in Brussels which said that bwin.party’s arguing has not legal merit whatsoever. This means that the litigation has been dismissed, but bwin party still has the possibility to take the case further to a higher court if desired.
It’s not yet sure if bwin party will continue pursuing this legal case, but considering that the venture is one of the main opponents of the current Belgian online gambling legislation it’s likely that this case is far from being over. This case and bwin party’s behavior will most likely be closely watched by the Nevadan Gambling Control Commission as well. This month bwin party will have to appear before the Commission to discuss its possible online gambling license and it’s a well-known fact that Nevada dislikes operators that had or have legal troubles in other jurisdictions. Belgium adopted a new online gambling legislation on January 1st 2012. One of the most controversial aspects of this legislation is the fact that it forces Belgian ISPs to block citizens’ access to unlicensed online gambling operators. At the moment more than 30 operators including William Hill and bwin party are blacklisted in Belgium.
